Tendwell Terms of Service
Last updated: October 17, 2026
What changed in this version
| Section | Change |
|---|---|
| 1, 2 | Clearer that Tendwell is not a party to any job and pros are independent businesses, not our employees or contractors. Added an 18+ age requirement. |
| 4 | New: where Tendwell works (markets/towns) and how service radius works, including that distance is estimated from ZIP code centers. |
| 6 | New: when a pro sees a customer's contact details (only after a booking or an accepted quote). |
| 7 | New: Pro Customer List (CRM): what pros can store, who can see it, CSV export, the 25 hand-added customer limit on the free plan, and the pro's responsibilities for that data. |
| 8 | Rewritten: two-way ratings. Customers rate pros (public). Pros rate customers (private). |
| 9 | Expanded public-record (CSLB) listings: hidden/staged listings, claims and removal requests. |
| 11 | New: what Tendwell admins can do (hide listings, moderate ratings, suspend or delete accounts with a recorded reason, audit log). |
| 12 | Service emails are now sent through our email provider (Resend); opt-out of notification emails. |
| 15 | New: "Coming soon" features (payments, platform fee, paid Pro plan, visit reports with photos, text messages). They aren't live, and these terms will be updated before they launch. |
| 16–19 | Added indemnity (for pros), a short informal-dispute step, and updated contact details ([email protected]). |
These terms are an agreement between you and Tendwell ("Tendwell," "we," "us"). Tendwell is currently operated by Kevin Eidsvold in Fallbrook, California. They cover tendwellapp.com, app.tendwellapp.com and the Tendwell mobile apps (together, "Tendwell"). By creating an account or using Tendwell, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Tendwell.
1. Tendwell is a venue, not the contractor
Tendwell helps residents ("customers") find, message, get quotes from, schedule and rate local home-service professionals ("pros"), and gives pros simple tools to run their business.
- We don't do the work. Tendwell doesn't perform, supervise or guarantee any home service.
- We are not a party to the job. Any quote, booking, agreement, warranty, payment or dispute for work is between the customer and the pro.
- Pros are independent. Pros are independent businesses. They are not Tendwell's employees, agents, partners or contractors. Pros decide whether to take a job, how to do it, what to charge, when they work, and what tools and helpers they use. Tendwell doesn't control or direct their work.
- We aren't responsible for the quality, safety, timing, legality or price of any work, or for anything a customer or pro does or doesn't do.
2. Who can use Tendwell
You must be at least 18 and able to enter a binding contract. Tendwell is for lawful home-service purposes in the areas we serve. Business accounts must be used by someone authorized to act for that business.
3. Your account
- Give accurate information and keep it up to date.
- We sign you in with a one-time code sent to your email. Keep your email account secure. You're responsible for activity on your Tendwell account.
- One person per account. Don't share or sell accounts.
- Tell us right away at [email protected] if you think someone else got into your account.
4. Where we work: markets and service radius
- Tendwell launches town by town ("markets"), starting with the Fallbrook area. We may stage listings for a new town before it opens. Staged listings stay hidden from the public until that town launches.
- When pros sign up or claim a listing, they choose how far they'll travel (currently 5, 10, 15, 25 or 50 miles; the default is 15). Customers see pros whose radius covers the customer's ZIP code, plus pros who list that ZIP.
- Distances are estimates. We measure from the center of the pro's base ZIP code to the center of the customer's ZIP code. We don't use GPS or exact addresses for this. A pro listed as covering your ZIP may still decline a job, and a pro just outside the radius may still be willing to help.
5. Pros: licenses, insurance and conduct
- Pros are solely responsible for holding every license, registration, permit, bond and insurance policy the law requires for their work and keeping them current. This includes a California Contractors State License Board (CSLB) license where required (generally for jobs of $1,000 or more in combined labor and materials).
- Pros are responsible for their own taxes, business expenses, employees, helpers and subcontractors, and for following all laws, including consumer-protection and home-improvement contract rules.
- Badges such as "License verified" or "Insured" reflect a check we made on the date shown. They aren't a guarantee and can go out of date. Customers should confirm a license at cslb.ca.gov before hiring.
6. Quotes, bookings, messages and contact details
- Customers can message pros, request quotes and book visits in the app. Quotes and bookings are arrangements between the customer and the pro.
- Contact details are shared in steps. Before a booking or an accepted quote, a pro sees a customer's short display name (for example "Jordan S.") and the job details the customer shares. A pro sees a customer's full name and email only after the customer books that pro or accepts that pro's quote.
- Use contact details you get through Tendwell only for the job you were contacted about and related follow-up. Don't sell them, share them, or add them to unrelated marketing lists.
- Right now, Tendwell does not process payments. Any price shown is the pro's quote or estimate. Payment, deposits, refunds and disputes are between the customer and the pro. (See Section 15 for planned payments.)
7. Pro Customer List (CRM)
Pros get a free customer list in the Pro dashboard.
What it does. Customers you deal with on Tendwell (through bookings, quotes or chats) are added to your list automatically. You can also add customers by hand and store contact details, properties (address, access notes, pets, other details), private notes, tags, follow-up reminders and re-quotes. You can export your list as a CSV file.
Who can see it. Your customer list is private to your business. Other pros and customers can't see it. Customers can't see the notes or tags you keep about them. Tendwell admins can access it only to run, secure and support the service, to comply with law, or to investigate a reported problem (see Section 11 and the Privacy Policy).
Free plan limits. The free plan includes up to 25 customers added by hand. Customers who come to you through Tendwell don't count toward that limit. We may change plan limits with notice. If a limit goes down, we won't delete customers you already have.
Your responsibilities for CRM data. For anything you add or keep in your list:
- You must have the right to store it. For hand-added customers, that means you got their information lawfully, for example as your own customer.
- Keep it accurate, only keep what you need, and don't store sensitive information such as Social Security numbers, bank or card numbers, health information, or alarm codes and passwords.
- Notes about a customer should be factual and professional. No discriminatory, harassing or defamatory content.
- You are responsible for how you use exported data and for following privacy, anti-spam and telemarketing laws (for example CAN-SPAM, the TCPA and California privacy law) when you contact customers. Tendwell doesn't currently send marketing emails or texts on your behalf.
- For your hand-added customers, you decide what data is collected and why, and Tendwell stores it for you as a service provider.
Tendwell-sourced customers. Customers who came to you through Tendwell stay on your list as a record of your work with them. You can archive them, but you can't delete them from your list. If that customer deletes their Tendwell account, their entry is removed from your list, along with the properties, notes and follow-ups attached to it. Export first if you need records for your own business (for example taxes or warranties).
When you leave. Export your list before you close your account. When a business account is deleted, its customer list is deleted with it, subject to the Privacy Policy's retention section.
8. Ratings
Tendwell uses star ratings in both directions. Ratings must be honest and first-hand and must relate to a real job.
Customers rate pros (public). After a completed booking, the customer can rate the pro from 1 to 5 stars on Timeliness, Cleanliness, Quality, Communication and Value. These ratings appear on the pro's public listing marked "Booked on Tendwell." Neighbor vouches come from residents with a verified local ZIP code.
Pros rate customers (private). After a completed visit, the pro can rate the customer from 1 to 5 stars on Communication, Accuracy, Property Access, Respect and Payment. Customer ratings have no written comments. They are not public. A customer's rating summary can be seen only by:
- pros who already have a quote request, chat or booking with that customer,
- the customer themself, and
- Tendwell admins.
Rules for everyone. No paid, incentivized, fake, retaliatory, or "rate me and I'll rate you" ratings. No personal information, hate or threats. Don't use customer ratings to discriminate based on a protected characteristic such as race, religion, sex, disability, national origin, age or familial status.
Moderation. We may hide or remove ratings that break these rules or the law. We don't remove ratings just because they're negative, and nobody can pay us to change a rating. If you think a rating is unfair or fake, email us and we'll look at it.
9. Public-record listings (CSLB data), claims and removal
- Some listings are marked "Unclaimed listing." We build them only from public California Contractors State License Board records: business name, license number, classifications, city and license status as of the date shown. They aren't endorsements, and the business hasn't joined Tendwell.
- We don't show contact details on unclaimed listings. We keep the public-record phone and mailing address privately so we can tell the business about its listing.
- Claiming: a business owner can tap "Is this your business? Claim it." After we confirm ownership, the owner controls and edits the listing.
- Removal: a business can ask us to remove its unclaimed listing by emailing [email protected] or calling (442) 222-9328. We aim to handle removal requests within 10 business days.
- License data can go out of date. We refresh it from time to time, but always check cslb.ca.gov.
10. Your content
You keep ownership of what you post: listing details, photos, messages, quotes, ratings and CRM notes ("your content"). You give Tendwell a non-exclusive, royalty-free license to host, store, display and process your content only as needed to run, improve and promote Tendwell. For public listing content and public ratings, this includes showing them on Tendwell and in Tendwell marketing. Private content (messages, CRM data, customer ratings) is used only to provide the service. You promise you have the rights to what you post, including photos.
11. Acceptable use and what admins can do
Don't: spam; harass; discriminate; post fake listings, fake jobs or fake ratings; impersonate anyone; scrape or bulk-download data; try to get around the contact-sharing rules or security; upload malware; or use Tendwell for anything illegal.
Tendwell admins (currently Kevin Eidsvold and Matt Hoye) may, to keep Tendwell safe and working:
- hide, edit or unpublish listings (for example outdated license data, a confirmed problem, or a staged town that isn't live yet);
- approve or revoke listing claims;
- hide or remove ratings and other content that break these terms;
- update booking or quote status to fix errors or resolve reports;
- suspend an account (a suspended account can't create new activity) or delete an account.
Admins must enter a reason for suspensions, deletions and other overrides. Every admin change is recorded in an internal audit log showing who made it, when, what changed and why. We'll usually tell you why we took action, unless that would be unsafe or illegal. To appeal, email [email protected].
12. Emails and notifications
We send service emails through our email provider, Resend: sign-in codes, and notifications about quotes, messages, bookings and listing claims. You can turn off notification emails in the app under Profile. Sign-in codes and important account or legal notices can't be turned off. We don't send marketing email without the choice to unsubscribe.
13. Closing your account
You can ask us to delete your account at any time by emailing [email protected]. Pros should export their customer list first. What we keep after deletion, and for how long, is described in the Privacy Policy.
14. Changes to Tendwell
Tendwell is new and changing quickly. We may add, change or remove features, plan limits or markets. If a change materially reduces what a free feature does for you, we'll tell you in the app or by email.
15. Coming soon (not live yet)
These features are planned but not live today. They are listed so you know what's coming. Before any of them launches, we'll update these terms and the Privacy Policy and tell you.
- Payments through Stripe Connect. Customers would pay pros in the app. Stripe would process payments and pay out to pros, and pros would agree to Stripe's terms. Tendwell would charge pros a platform fee on paid jobs. Fees will be shown before they apply.
- Paid Pro plan. A monthly subscription for pros with extra CRM features (for example more customers, automatic re-quotes, win-back campaigns, AutoPay and a lower platform fee). It would follow California's automatic-renewal rules, including clear pricing and easy online cancellation. Founding Pros were promised Pro free for their first 12 months.
- Visit reports with photos. Pros would send customers a visit report (checklist, notes, before/after photos, quotes and invoices).
- Text messages (SMS) via Twilio. Only with your consent. Reply STOP to opt out.
16. Disclaimers
Tendwell is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise Tendwell will be uninterrupted or error-free, or that any listing, rating, license badge or distance is accurate.
17. Limits on liability
To the fullest extent the law allows, Tendwell isn't liable for indirect, incidental, special, consequential or punitive damages, or for any work, injury, property damage or loss that comes from dealings between customers and pros. Our total liability to you for any claim related to Tendwell won't exceed the greater of $100 or what you paid Tendwell in the 12 months before the claim. Nothing in these terms limits rights you have under California law that can't be waived.
18. Indemnity (pros)
If you use Tendwell as a pro, you agree to defend and indemnify Tendwell against claims from your work, your breach of these terms or the law, or your use of customer data, including data in your Customer List.
19. Disputes and governing law
- Talk to us first. If you have a problem with Tendwell, email [email protected] and give us 30 days to try to fix it.
- These terms are governed by California law. Disputes will be handled in the state or federal courts in San Diego County, California, unless the law requires otherwise. Either side may use small claims court where it qualifies.
20. Changes to these terms
We may update these terms. We'll post the new "Last updated" date here. For material changes, we'll notify you in the app or by email before they take effect. If you keep using Tendwell after that, you accept the new terms.
